CYBER CRIME ACT 2020

Currently a Bill

Being an Act to provide for the prevention of the abusive use of computer systems; to provide for the timely and effective collection of electronic evidence for the purpose of investigation and prosecution of cybercrime; to provide for the protection of Critical National Information Infrastructure; to provide for facilitation of international cooperation in dealing with cybercrime matters and to provide for other related matters.

PART 1–PRELIMINARY

  1. Definitions.

PART II - CRITICAL NATIONAL INFORMATION INFRASTRUCTURE

  1. Designation of certain computer systems as Critical National Information Infrastructure.
  2. Audit and inspection of Critical National Information Infrastructure.

PART III - POWERS AND PROCEDURES

  1. Scope of powers and procedures.
  2. Search and seizure of stored computer data.
  3. Record of and access to seized data.
  4. Production order.
  5. Expedited preservation and partial disclosure of traffic data.
  6. Real-time collection of traffic data.
  7. Interception of content data.
  8. Confidentiality and limitation of liability.
  9. Territorial jurisdiction.

PART IV - INTERNATIONAL COOPERATION

  1. Spontaneous information.
  2. Powers of the Attorney-General.
  3. Authority to make and act on mutual assistance requests.
  4. Extradition.
  5. Confidentiality and limitation of use.
  6. Expedited preservation of stored computer data.
  7. Expedited disclosure of preserved traffic data.

Cybercrime law identifies standards of acceptable behavior for information and communication technology (ICT) users; establishes socio-legal sanctions for cybercrime; protects ICT users, in general, and mitigates and/or prevents harm to people, data, systems, services, and infrastructure, in particular; protects human rights; enables the investigation and prosecution of crimes committed online (outside of traditional real-world settings); and facilitates cooperation between countries on cybercrime matters, law provides rules of conduct and standards of behaviour for the use of the Internet, computers, and related digital technologies, and the actions of the public, government, and private organizations; rules of evidence and criminal procedure, and other criminal justice matters in cyberspace; and regulation to reduce risk and/or mitigate the harm done to individuals, organizations, and infrastructure should a cybercrime occur. Accordingly, cybercrime law includes substantive, procedural and preventive law.

I'm in full support of the Cyber crime act2020.

Because it can help to regulate illegal access to data collection of information about person and institutions that serve as a threat to the peace of this country.

I want to condemn the Honourable Minister and his team for a job well done.
